1. Agreement and operator
These Terms of Use form an agreement between you and:
Thomas Roth
Hitzendorf 9
8151 Hitzendorf
Austria
Email: support@tami-cycle.com
By downloading, purchasing, or using Tami, you agree to these terms. If you do not agree, do not use the app. Google Play may also apply its own terms to your download, trial, purchase, and subscription.
2. Eligibility
You must be at least 18 years old to download, purchase, or use Tami. Tami is not offered for use by minors. You must also be legally able to enter into a contract for any paid subscription.
3. What Tami provides
Tami is a personal cycle companion that can record period dates, optional symptoms and intimacy logs, calculate cycle and period averages, display estimated period and fertile windows, and show locally generated patterns or messages. Features may differ by platform, country, app version, or subscription plan.
Tami is designed to work without a Tami account. Sensitive cycle information is stored locally on your device in the current design, as explained in the Privacy Policy.
4. Health and prediction limits
Tami is not a medical device, healthcare provider, diagnostic service, fertility treatment, or contraception method. Predictions and pattern messages are estimates generated from the information available on your device. They can be inaccurate, particularly when cycles are irregular, data is incomplete, or health circumstances change.
- Do not use Tami to prevent pregnancy or as the only basis for trying to conceive.
- Do not delay professional care because of information shown by Tami.
- Seek qualified medical advice about symptoms, pregnancy, fertility, contraception, or changes that concern you.
- For urgent or emergency concerns, contact your local emergency service.
The separate Health Disclaimer is part of these terms.
5. Local data and your device
You are responsible for protecting access to your device and for checking the accuracy of information you enter. Because Tami does not hold a server copy of your cycle history, we generally cannot recover it if you delete app data, uninstall the app, lose the device, or experience storage failure. Device or cloud backups are controlled by you and your platform provider.
6. Free trial and subscriptions
6.1 Offer shown at purchase
Tami may offer an eligible free trial followed by an auto-renewing monthly or yearly subscription. Availability can depend on your country, account, previous trial use, and Google Play eligibility.
The offer, trial eligibility, currency, taxes, duration, renewal price, and billing period displayed in the Google Play purchase screen when you subscribe are the binding purchase terms.
6.2 Trial conversion and renewal
If the store confirms that you are eligible for a free trial, you will not be charged during the stated trial period. Unless you cancel through the store before the trial ends, the subscription automatically converts to the selected paid plan and the store charges the price shown in the purchase screen. The subscription then renews automatically for the same billing period until canceled, subject to any price change or notice required by the store and applicable law.
Trial eligibility is determined by the app store and may be limited to new or qualifying subscribers. Reinstalling Tami, deleting local app data, or changing devices does not create a new entitlement to a trial.
6.3 Payment
Google processes the transaction using the payment method connected to your Play account. Tami does not receive your full payment-card or bank details. Taxes, currency conversion, billing failures, grace periods, and account holds may be handled under Google Play's rules.
6.4 Cancellation
You can manage or cancel your subscription in Google Play subscription settings. Deleting Tami, deleting local app data, or stopping use of the app does not cancel a subscription. Cancellation normally takes effect at the end of the current paid billing period, and access normally continues until then, unless Google Play or applicable law provides otherwise.
6.5 Refunds, withdrawal, and mandatory rights
Refund requests and store purchases are handled under the applicable app store's rules and the consumer law that applies to you. Consumers may have statutory rights concerning withdrawal, conformity of digital services, price changes, cancellation, or refunds. Nothing in these terms restricts a right that cannot legally be restricted. Contact the store through which you purchased first; you may also contact support@tami-cycle.com for help locating the correct process.
6.6 Restore purchases
You may restore an eligible Tami purchase while signed in to the same Google Play account used for the original transaction. Restoration depends on Google Play's records and rules.
7. License and intellectual property
Subject to these terms and any applicable store rules, Tami grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for lawful, non-commercial purposes. Tami, its mascot, artwork, text, interface, software, branding, and other content are owned by the operator or its licensors and are protected by applicable intellectual-property laws.
8. Acceptable use
You must not:
- use Tami unlawfully, fraudulently, or in a way that harms another person;
- copy, sell, rent, sublicense, redistribute, or commercially exploit the app or its assets without permission;
- reverse engineer, decompile, bypass, or interfere with Tami except where applicable law expressly permits it;
- circumvent subscription controls, access restrictions, or security measures;
- introduce harmful code or attempt unauthorized access to the app, store services, or related systems; or
- misrepresent Tami's estimates as medical advice or guaranteed fertility information.
9. Your inputs and support materials
You retain your rights in information you enter into Tami. You permit the app to process that information locally to provide the features you request. If you send screenshots, logs, or other materials to support, you permit us to use them only as reasonably needed to investigate your request, protect the service, or meet legal obligations. Avoid sending unnecessary health or intimacy information.
10. Availability and changes
We aim to keep Tami reliable, but we do not promise uninterrupted or error-free availability. Operating-system changes, device limitations, store outages, maintenance, or technical problems may affect the app. We may improve, modify, suspend, or discontinue features. If a change materially affects a paid service, we will provide notice and remedies where required by the app store or applicable law.
11. Suspension and termination
You may stop using Tami at any time, but you must separately cancel any active subscription. We may restrict or end access if you materially breach these terms, misuse the app, or if continued operation becomes unlawful or technically impossible. Any action will remain subject to your mandatory consumer rights and applicable store rules.
12. Disclaimers and liability
Tami is provided with the level of care required by applicable law. To the extent legally permitted, Tami is otherwise provided "as available" and without promises that every estimate, message, feature, or result will be accurate or suitable for your individual circumstances.
You remain responsible for decisions based on the app and for maintaining appropriate medical, contraceptive, fertility, and device-security practices. We are not responsible for loss caused solely by inaccurate or incomplete information you enter, failure to protect your device, or use of Tami contrary to these terms.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including applicable liability for intentional misconduct, gross negligence, personal injury, mandatory product or digital-service rights, or other non-excludable consumer protections. Any further limitation applies only to the maximum extent allowed by the law that protects you.
13. Third-party services
Tami relies on platform services supplied by Google, device manufacturers, and operating-system providers. Their services are governed by their own terms and privacy notices. Tami is not responsible for an independent third party's service, but this does not reduce rights you may have against Tami under mandatory law.
14. Governing law and disputes
These terms are governed by Austrian law, excluding its conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country where you habitually live. Courts with jurisdiction under applicable consumer law may hear disputes.
Please contact support@tami-cycle.com first so we can try to resolve a concern. Information about any applicable consumer dispute-resolution procedure will be provided where required by law.
15. Changes to these terms
We may update these terms when Tami's features, subscriptions, service providers, or legal obligations change. We will post the updated version, change the "Last updated" date, and provide additional notice where required. Changes will not retroactively remove rights already earned under applicable law.
